Trademark Registration Procedure: Step by Step

 

  • Preliminary search (checking for similar marks): before filing, ensure the proposed sign is unique. Searches are conducted in UNIOII and WIPO databases to avoid the risk of refusal.
  • Choosing classes of goods and services: a trademark is registered within specific Nice Classification (NCL) classes. The correct choice of classes determines the scope of legal protection.
  • Filing the application with UNIOII: the application includes an image or description of the sign, the list of classes, applicant data, and proof of fee payment. After filing, the priority date is established.
  • Formal examination: verification of document correctness and fee payment.
  • Substantive examination: assessment of the sign’s distinctiveness and absence of identical or confusingly similar marks.
  • Obtaining the certificate: after a positive decision and payment of the state fee, the applicant receives the Certificate of Ukraine for the Mark for Goods and Services.

The standard procedure takes 12–18 months. Accelerated registration is possible within 6–8 months, and an express procedure—up to 4 months. The duration depends on the number of classes and the complexity of the examination.
